AI Render Terms

These Terms form part of the Terms of Use of Mezhdunarodnye internet resursy LLC (OOO «MIR») (the "Operator", KONTEON). They apply when images (renders) are created from a project using artificial intelligence models. Before your first render, you confirm your acceptance of these Terms by ticking a separate box.
1. How Rendering Works
1.1. To create a render, the Service takes a snapshot of the project's 3D model and sends it, together with the text of your prompt, to a third-party AI service. The models are developed and operated by third-party companies abroad. Personal data (email, name, phone number, account identifier) is not transferred.
1.2. Third-party AI services may use the images and texts sent to them in depersonalized form to improve their products. The usage policies of these services are incorporated into these Terms as regards their prohibitions.
1.3. Renders are created in exchange for credits under the Paid Services Terms. The models, quality and number of credits per render are shown in the interface.
2. What a Render Is
2.1. A render is an illustration, not design documentation. It may differ from the project and from the actual building: dimensions, proportions, materials and surroundings are shown approximately. A render is not an offer to build or supply anything.
2.2. Renders are provided "as is". The Operator does not guarantee that a render is unique, bears no resemblance to other images, or meets your expectations.
3. Rights to Renders
3.1. Renders are the property of KONTEON. All rights to renders, to the extent such rights arise, belong to the Operator.
3.2. You are granted a free, non-exclusive license to use each render you create in any way, including commercially: in commercial proposals to clients, on websites, on social media, in advertising and in print, in perpetuity and worldwide.
3.3. You may not: claim to be the author or rights holder of a render; register a render or any part of it as a trademark, industrial design or other object of rights; transfer exclusive rights to a render to anyone; prohibit the Operator from using a render; or demand its removal from the Operator's archive.
3.4. You agree that the Operator may, free of charge, in perpetuity and without attribution to you, use renders, 3D model snapshots and scene parameters in its materials: on its websites, on social media (including Pinterest) and in advertising. In such publications, renders appear with a KONTEON watermark and without your name, logo or your clients' data. This cannot be opted out of on any plan.
3.5. The Operator stores all renders indefinitely, including those you have deleted (they are hidden from you).
3.6. On the Free plan, renders carry a KONTEON watermark; removing it is prohibited. On paid plans, the credit "Visualization: KONTEON" is not required.
4. Prohibited in Prompts and in the Use of Renders
- images of real people and their recognizable likeness, or faked images of people (deepfakes);
- third-party trademarks, logos and brands;
- adult content, violence, unlawful or offensive material;
- personal data: names, phone numbers, addresses, email addresses;
- passing off a render as a photograph of a real property for the purpose of deception;
- removing or altering labels and metadata indicating that an image was created using AI.
The Service automatically removes phone numbers and email addresses from prompts and may reject a request. A model refusal caused by a prompt affects the refund of the credit (Paid Services Terms, clause 5.4).
5. AI Labeling
Images created in the Service are labeled as AI-generated, both in the interface and in the file metadata. Labels applied by model providers are preserved.
6. Liability
The Operator's liability for failures of AI services is limited to returning the credit. The user is responsible for the use of a render (including in advertising and in contracts with clients). The Operator may restrict access to a render if these Terms are violated.
